Terms of Service

1. The Agreement
These Terms of Service govern access to and use of the hosted CRM platform at crm.havasuwebstudio.com (“the Service”), operated by Havasu Web Studio of Lake Havasu City, Arizona (“we,” “us”). By creating an account or using the Service, you agree to these Terms. The Service is provided to businesses we work with under a separate service engagement; where a signed agreement between us and your business conflicts with these Terms, the signed agreement controls.
If you are a customer or lead of a business that uses the Service — for example, you submitted a contact or booking form on their website — Section 5 (Text Messaging Program) and our Privacy Policy describe how the Service interacts with you.
2. The Service
The Service is a hosted business platform that includes contact and pipeline management, hosted contact forms and booking pages, calendars and tasks, reporting, and email and text-message communication tools. Each business operates in its own isolated workspace. Access is by invitation from us or from your business’s workspace administrator.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
By providing a mobile phone number in your workspace settings or service engagement, you agree to receive operational text notifications from Havasu Web Studio about your account — such as new-lead alerts, missed-call alerts, and booking notifications. Message frequency varies with your lead volume. Message and data rates may apply. Reply STOP to any message to opt out, or HELP for help.
4. Acceptable Use and Messaging Compliance
You agree to use the Service only for lawful business purposes. In particular, when sending email or text messages through the Service, you are responsible for ensuring that:
- every recipient has given appropriate consent to be contacted, as required by applicable law (including the TCPA for text messages and CAN-SPAM for email);
- messages accurately identify your business and are not deceptive; and
- content complies with carrier rules, including prohibitions on content involving illegal substances, hate speech, and other restricted categories.
The Service enforces opt-outs automatically: recipients who reply STOP to a text or use an email unsubscribe link are excluded from further automated messaging. Attempting to circumvent opt-out handling is a violation of these Terms and grounds for suspension.
5. Text Messaging Program (Message Recipients)
This section is for people who receive text messages sent through the Service — typically customers and leads of the businesses we serve who opted in on a contact or booking form.
- Who is texting you: messages are sent by Havasu Web Studio, the messaging provider for the business you contacted. Messages relate to your request — such as confirmations, follow-ups, and appointment reminders.
- Frequency and rates: message frequency varies with your interaction. Message and data rates may apply according to your mobile plan. Consent is not a condition of any purchase.
- Opting out: reply STOP at any time to stop receiving messages — the opt-out takes effect immediately. Reply HELP for help, or contact us at the address in Section 13.
- Carriers: mobile carriers are not liable for delayed or undelivered messages.
6. Fees
Fees for the Service are set out in your service engagement with Havasu Web Studio. There is no self-serve billing through the platform itself. Third-party messaging costs (such as carrier fees for text messages) may be passed through as described in your engagement.
7. Your Data
Your business owns the customer records, messages, and other content in its workspace. We access it only to operate, support, and secure the Service, as described in our Privacy Policy. You can request an export of your workspace data at any time, and deletion of your workspace data when your engagement ends.
8. Availability and Third-Party Services
We work to keep the Service available and reliable, but it depends on third-party infrastructure (hosting, database, email, and telephony providers) and is provided without a guaranteed uptime level. We may modify features of the Service as it evolves; we will not materially reduce the core functionality your engagement depends on without notice.
9. Suspension and Termination
We may suspend or terminate access for material violation of these Terms, including messaging-compliance violations, or when a service engagement ends. You may stop using the Service at any time; on request we will export and then delete your workspace data.
10. Disclaimers and Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Havasu Web Studio’s total liability arising out of or relating to the Service is limited to the amounts paid by your business for the Service in the three months before the claim arose, and we are not liable for indirect, incidental, or consequential damages, or for the acts of third-party providers.
11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Arizona.
12. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date and notify active clients of material changes. Continued use of the Service after changes take effect constitutes acceptance.
